Official Rules
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Tommy Bahama® TB Trick or Treat Halloween Giveaway (“Giveaway"). Winning a prize is contingent upon fulfilling all requirements set forth herein.
1. SPONSOR: Tommy Bahama Group, Inc., 400 Fairview Avenue North, Suite 488, Seattle, Washington 98109 (“Sponsor"). The Giveaway is in no way sponsored, endorsed or administered by, or associated with, Instagram.
2. ELIGIBILITY: This Giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older as of Monday, October 31, 2022 and follow @TBahama on Instagram. Employees, officers and directors of Sponsor, its parent, affiliates, subsidiaries, divisions, suppliers and advertising and promotional agencies and the immediate family members and persons living in the same household as such employees, officers and directors are not eligible to participate or win.
3. GIVEAWAY PERIOD: The Giveaway begins on Monday October 31, 2022 at 9:00 AM Pacific Time and ends once Tommy Bahama receives the first 100 responses via direct message or by responding to our Instagram story, or at 9:00 AM Pacific Time on November 1, 2022, whichever comes first.
4. HOW TO ENTER: To enter (1) follow @TBahama on Instagram, (2) be one of the first 100 people to respond to our Trick or Treat story by replying “Trick or Treat.” ALL ENTRIES MUST BE RECEIVED BY 9:00 AM PT ON NOVEMBER 1, 2022. Entrants can enter once during the Giveaway Period. Each entrant will receive only one (1) entry. Use of multiple usernames or accounts to enter by the same individual is prohibited and may result in disqualification. All submissions become the property of the Sponsor upon receipt and will not be acknowledged or returned. Sponsor's computer is the official time-keeping device for the Giveaway. The Giveaway is governed by these Official Rules and is subject to all applicable U.S. federal, state and local laws. Void where prohibited.
5. GRANT OF RIGHTS / REPRESENTATIONS AND WARRANTIES: Each entrant into each Giveaway hereby irrevocably grants to Sponsor, and each of its affiliates, licensees, successors and assigns, a non-exclusive, non-transferable, royalty-free perpetual license to use and display any photo with entry for any and all purposes in any and all media channels without limitation, worldwide and without additional compensation, notice or approval from entrant. Each entrant hereby represents and warrants that he/she has read, understands and will follow these Official Rules. Entrants further represent and warrant that any photos with entries and all elements therein (except Sponsor content) submitted as part of each Giveaway are: (i) the original work of the entrant, and (ii) will not infringe or violate any right (including without limitation intellectual property, proprietary rights, or personal rights) of any third party or person. Each entrant further represents and warrants that he/she has the permission and right to agree to and fully perform in a manner consistent with these Official Rules.
6. PRIZES: 100 winners total will be selected to receive either one (1) of twenty nine (29) total copies of the Marlin Bar Cocktail Book (approximate retail value: $40 each) OR one (1) of seventy-one (71) total Silipint pint (approximate retail value: $11 each). No prize transfers permitted. Prizes are subject to these terms and conditions and may not be returned, redeemed for cash or used as payment on or credit to any credit card accounts. Prizes will not be replaced if lost or stolen. Winners are solely responsible for all applicable taxes in connection with prize. Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for any prize, for any reason.
7. WINNER SELECTION AND NOTIFICATION: A total of 100 winners will be selected on or about October 31, 2022 as determined by the first 100 valid entries. The decision of Sponsor will be final and binding on all matters related to the Giveaway. The Winners will be notified on Instagram by direct message and asked to email a representative of Sponsor. If the winner cannot be reached by direct message on Instagram within 5 days of first notification attempt, an alternate winner may be selected. Odds of winning will be determined by the total number of eligible entries.
8. GENERAL CONDITIONS AND RELEASE: Void where prohibited or restricted by law. All federal, state, and local laws apply. Winner agrees to hold harmless, indemnify and defend Instagram, Sponsor and its parent, partners, affiliates, subsidiaries, divisions, suppliers and advertising and promotional agencies and all of their respective officers, directors, agents, representatives and employees (collectively, the “Released Parties against any and all liability, damages or causes of action (however named or described), with respect to or arising out of entrant’s participation in the Giveaway or the receipt, use or misuse of the prize. Acceptance of prize constitutes permission to use winner’s name, Instagram handle, likeness, entry and photograph for promotional purposes without further compensation except where prohibited by law. Potential winners may be required to sign and return an Affidavit of Eligibility, Release of Eligibility and Publicity Release and Liability Release by the date specified by Sponsor and failure to do so may result in an alternate winner being selected. Return of prize notification as undeliverable will result in disqualification and alternate selection. By participating, entrants agree to be bound by the decisions of the judges and these Official Rules. Sponsor is not responsible for lost, interrupted or unavailable network server or other connection; miscommunications; failed phone or computer or telephone transmissions; technical failure; jumbled, scrambled or misdirected transmissions; late, lost, incomplete, delayed, or misdirected entries; or other error of any kind whether human, mechanical, or electronic. CAUTION: Any attempt to deliberately damage any web site, or undermine the legitimate operations of the Giveaway, is a violation of the criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law and to disqualify such entrant from the Giveaway. In the event the Giveaway is compromised by virus, bug, unauthorized human intervention, or other causes beyond the control of Sponsor that corrupts or impairs the administration, security, fairness, or proper play of the Giveaway, Sponsor reserves the right in its sole discretion to suspend or terminate the Giveaway and award prize from all eligible entries received prior to cancellation. Sponsor may disqualify entries if the entry and related tag includes inappropriate, offensive, or other derogatory language or information. Limit one (1) entry per person during the Giveaway Period.
