Official Rules
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Administrator’s decisions, which are final and binding in all matters related to the Tommy Bahama® National Plan Your Vacation Day Giveaway (“Giveaway”). Winning a prize is contingent upon fulfilling all requirements set forth herein.
1. SPONSOR: Tommy Bahama Group, Inc., 400 Fairview Avenue North, Suite 488, Seattle, Washington 98109 and Indian Wells Property, LLC (“Sponsors”). The Contest is in no way sponsored, endorsed or administered by, or associated with, Instagram.
2. ADMINISTRATOR: Tommy Bahama Group, Inc., 400 Fairview Avenue North, Suite 488, Seattle, Washington 98109 (“Administrator”).
3. ELIGIBILITY: This Giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older as of January 27, 2026 and follow @TBahama and @tbmiramonteresort on Instagram. Employees, officers and directors of Administrator, Sponsors, their parent, affiliates, subsidiaries, divisions, suppliers and advertising and promotional agencies and the immediate family members and persons living in the same household as such employees, officers and directors are not eligible to participate or win.
4. GIVEAWAY PERIOD: The Giveaway begins on January 27, 2026 at 9:00 AM Pacific Time and ends at 11:59 PM Pacific Time on February 3, 2026.
5. HOW TO ENTER: To enter (1) follow @TBahama and @tbmiramonteresort on Instagram, (2) like the @TBahama National Plan Your Vacation Day Giveaway post, and (3) tag a friend in the comments of the @TBahama National Plan Your Vacation Day Giveaway post. ALL ENTRIES MUST BE RECEIVED BY 11:59 PM Pacific Time on February 3, 2026. Entrants can enter one (1) time during the Giveaway Period. Each entrant will receive only one (1) entry during the Giveaway Period. Use of multiple usernames or accounts to enter by the same individual is prohibited and may result in disqualification. All submissions become the property of the Administrator upon receipt and will not be acknowledged or returned. Administrator’s computer is the official time-keeping device for the Giveaway. The Giveaway is governed by these Official Rules and is subject to all applicable U.S. federal, state and local laws. Void where prohibited.
6. GRANT OF RIGHTS / REPRESENTATIONS AND WARRANTIES: Each entrant into each Giveaway hereby irrevocably grants to Administrator, Sponsors, and each of their affiliates, licensees, successors and assigns, a non-exclusive, non-transferable, royalty-free perpetual license to use and display any photo with entry for any and all purposes in any and all media channels without limitation, worldwide and without additional compensation, notice or approval from entrant. Each entrant hereby represents and warrants that he/she has read, understands and will follow these Official Rules. Entrants further represent and warrant that any photos with entries and all elements therein (except Sponsor content) submitted as part of each Giveaway are: (i) the original work of the entrant, and (ii) will not infringe or violate any right (including without limitation intellectual property, proprietary rights, or personal rights) of any third party or person. Each entrant further represents and warrants that he/she has the permission and right to agree to and fully perform in a manner consistent with these Official Rules.
7. PRIZES: A trip for two (2) to the Tommy Bahama Miramonte Resort & Spa located in Indian Wells, CA. Trip package includes round trip coach-class air transportation for winner and one (1) guest from a major commercial airport near winner’s home in the continental United States (determined by Administrator in its sole discretion) (ARV of airfare: $1,200); three (3) nights' accommodations at the Tommy Bahama Miramonte Resort & Spa in Indian Wells, CA (single room, double occupancy, based on availability, blackout dates apply) (ARV of hotel stay: $1,200); two (2) 50-minute spa treatments at Spa Rosa (one per guest, choice of facial or massage) (ARV of spa treatments: $490); $250 resort credit; and a $500 Tommy Bahama gift card, terms and conditions apply. The Grand Prize winner is solely responsible for all applicable federal, state, or other tax obligations related to the Grand Prize. Administrator and Sponsors will not provide any further assistance toward the winner’s tax obligations. Winner must complete the trip within one (1) year from the drawing date or prize will be forfeited. Trip must be booked at least thirty (30) days prior to departure. Travel and accommodations are subject to availability and blackout dates. Travel must be round trip. Administrator will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in this Giveaway, and those set forth by the Administrator’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Unless child of winner, travel companion must be eighteen (18) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. If winner is a minor in his/her state of residence, travel companion must be winner’s parent/legal guardian. Travel companion must execute liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. If in the judgment of Administrator air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for round trip air travel at Administrator’s sole discretion. Administrator will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Administrator is not responsible if any event is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Administrator’s sole discretion. Approximate Retail Value (“ARV”): $3,640. Actual value may vary based on airfare fluctuations and distance between departure and destination, and fluctuations in price of hotel stay dependent on dates. Winner will not receive difference between actual and approximate retail value.
8. WINNER SELECTION AND NOTIFICATION: One (1) Grand Prize Winner will be selected on or about February 3, 2026 by random drawing from among all eligible entries during the Giveaway Period. The decision of Administrator will be final and binding on all matters related to the Giveaway. The winner will be notified on Instagram by direct message and asked to email a representative of Administrator. If a winner cannot be reached by direct message on Instagram within 48 hours of first notification attempt, an alternate winner may be selected. Odds of winning will be determined by the total number of eligible entries throughout the Giveaway Period.
9. GENERAL CONDITIONS AND RELEASE: Void where prohibited or restricted by law. All federal, state, and local laws apply. Winner agrees to hold harmless, indemnify and defend Instagram, Administrator, Sponsors and their parent, partners, affiliates, subsidiaries, divisions, suppliers and advertising and promotional agencies and all of their respective officers, directors, agents, representatives and employees (collectively, the “Released Parties”) against any and all liability, damages or causes of action (however named or described), with respect to or arising out of entrant’s participation in the Giveaway or the receipt, use or misuse of the prize. Acceptance of prize constitutes permission to use winner’s name, Instagram handle, likeness, entry and photograph for promotional purposes without further compensation except where prohibited by law. Potential winners may be required to sign and return an Affidavit of Eligibility, Release of Eligibility and Publicity Release and Liability Release by the date specified by Administrator and failure to do so may result in an alternate winner being selected. Return of prize notification as undeliverable will result in disqualification and alternate selection. By participating, entrants agree to be bound by the decisions of the judges and these Official Rules. Administrator or Sponsors are not responsible for lost, interrupted or unavailable network server or other connection; miscommunications; failed phone or computer or telephone transmissions; technical failure; jumbled, scrambled or misdirected transmissions; late, lost, incomplete, delayed, or misdirected entries; or other error of any kind whether human, mechanical, or electronic. Any attempt to deliberately damage any web site, or undermine the legitimate operations of the Giveaway, is a violation of criminal and civil laws. Should such an attempt be made, the Administrator reserves the right to seek damages from any such entrant to the fullest extent permitted by law and to disqualify such entrant from the Giveaway. In the event the Giveaway is compromised by virus, bug, unauthorized human intervention, or other causes beyond the control of Administrator that corrupts or impairs the administration, security, fairness, or proper play of the Giveaway, Administrator reserves the right in its sole discretion to suspend or terminate the Giveaway and award prize from all eligible entries received prior to cancellation. Administrator may disqualify entries if the entry and related tag includes inappropriate, offensive, or other derogatory language or information. Limit one (1) entry per person during the Giveaway Period.
10. RESPONSIBILITY OF PRIZE WINNER: Grand Prize winner will receive an IRS form 1099 at the end of the calendar year, a copy of which form will also be filed with the Internal Revenue Service. THE PRIZE WINNER IS RESPONSIBLE FOR REPORTING AND PAYING ANY AND ALL INCOME, SALES OR EXCISE TAXES THAT MAY APPLY TO ACCEPTING PRIZES; ADMINISTRATOR OR SPONSORS ARE NOT RESPONSIBLE FOR AND WILL NOT PAY ANY SUCH TAXES.
