1. Eligibility: Tommy Bahama Group, Inc. (the “Sponsor” or “Tommy Bahama”) "Reviewer of the Month” Promotion (the “Promotion”) is open only to legal residents of the fifty (50) United States (including District of Columbia) who are at least eighteen (18) years old at the time of entry. Employees of the Sponsor, and its parent and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsor: Tommy Bahama Group, Inc., 400 Fairview Ave. N, Suite 400 Seattle, WA 98109.

3. Promotion Period: The Promotion begins on August 1, 2023 at 12:01 AM PT and ends on July 31, 2024 at 11:59 PM PT (collectively, the "Promotion Period"). The Promotion consists of twelve (12) monthly promotions (“Monthly Promotion”), each beginning at 12:01 AM PT on the first day of a calendar month and ending on the last day of such calendar month at 11:59 PM PT (each one month period, a "Monthly Promotion Period"). Following the conclusion of a Monthly Promotion Period, one (1) prize winner (“Monthly Promotion Prize Winner”) will be randomly selected out of the eligible entries received during such Monthly Promotion Period to receive a prize as more particularly set forth below. All entries must be received by 11:59 PM PT on the last day of a Monthly Promotion Period to be eligible for that month's prize. The following chart provides an overview of the Promotion Periods and Drawing Dates:

4. How to Enter: To enter a Monthly Promotion, visit tommybahama.com during the Monthly Promotion Period and log into your Account. If you are not already a member of tommybahama.com, you can create an Account by clicking here. Once logged in, find the product you would like to review, click the “Write a Review” link and opine with a rating of 1 to 5 stars ("Review") about such product. You will automatically receive one (1) entry into the Monthly Promotion for every Unique Review you submit. A Unique Review is defined as a Review which: (i) pertains to a Tommy Bahama product which you have never before Reviewed, (ii) pertains to a Tommy Bahama product with which you have used, (iii) is complete, and (iv) complies with all Terms and Conditions applicable to Reviews. A Review may be positive, neutral, or negative about a Tommy Bahama product to be valid for entry. SPAM or fraudulent Reviews will not be posted or counted for entry into the Promotion.

Sponsor is not responsible for any entry which is lost, late, invalid, incomplete, or undeliverable, regardless of the reason for such non-submission. Sponsor is deemed to have received an entry when Sponsor's servers record that a Review has been submitted. Sponsor will not verify receipt of entries. In the event of a dispute over the identity of the individual submitting an entry, the entry will be deemed to be submitted by the authorized Account holder at the time of entry. The authorized Account holder is defined as the natural person whose information is on file with Sponsor as being associated with the Account under which the submission was made.

5. Selection of Winners and Odds: Receiving a prize is contingent upon compliance with these Official Rules. One (1) Monthly Promotion Prize Winner will be selected at the conclusion of a Monthly Promotion by a random drawing from all eligible entries received during the Monthly Promotion Period. The drawing will be conducted by representatives of Sponsor and will take place on or about the Drawing Dates listed above. Monthly Promotion Prize Winners will be notified by email at the email address listed in their Account within five (5) days of the Drawing Date and will be required to sign and return to Sponsor, within five (5) days of Sponsor's email notification, a completed Affidavit of Eligibility and Release Form in order to claim his/her prize. If a potential Monthly Promotion Prize Winner cannot be reached, fails to return a completed Affidavit of Eligibility and Release Form within five (5) days of Sponsor's email notification, is found to be ineligible or does not comply with these Official Rules, or declines the prize for any reason, an alternate winner will be selected in a random drawing from the remaining eligible entries received during the applicable Monthly Promotion ("Alternate Drawing"). Any prize returned as undeliverable will be forfeited and an alternate winner will be selected in an Alternate Drawing. Sponsor will conduct up to two (2) Alternate Drawings per prize to be awarded, after which time a Prize will remain unawarded. Odds of winning will depend upon the number of eligible entries received during each Monthly Promotion Period.

6. Prizes: Each Monthly Promotion Prize Winner will receive one (1) $500.00 Tommy Bahama Gift Card (each a "Gift Card”) (ARV: $500). Gift Cards are valid at U.S. Tommy Bahama stores, restaurants, tommybahama.com and tommybahamaoutlet.com. Each Gift Card is subject to all terms and conditions associated with its use. Gift Cards are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute any Gift Card with a prize of equal or greater value for any reason. Monthly Promotion Prize Winners are responsible for all taxes and fees associated with prize receipt and/or use. Limit: One (1) prize per person.

7. Release: By receipt of any Promotion prize, winners agree to release and hold harmless Sponsor and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.

8. Publicity: Except where prohibited, participation in the Promotion constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, videos, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event that any provision of these Official Rules is found to be invalid, illegal, void, or unenforceable, the remainder of the Official Rules shall remain in full force and effect and shall be construed as if the invalid, illegal, void, or unenforceable provision was not contained herein.

10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant's entry or play is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Promotion entry, if possible. If the Promotion, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

11. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of Washington; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington.

12. Entrant's Personal Information: By entering this Promotion, Entrant agrees to Sponsor’s use of his or her personal Information collected from entrants as detailed in Sponsor’s Privacy Policy.
